Boundaries of Inclusion: Analysing the Impact of LGBTQ+ Advocacy on Competing Interests and Values

By Shabi Sonar, Uma Sharma & Prachi Bhardwaj, National Law University and Judicial Academy, Assam.

Abstract

The recognition and right of LGBTQ+ individuals remain a global debate, often clashing with traditional norms and legal frameworks. While historical records reveal the presence of same-sex relationships in ancient civilizations, colonial era laws criminalized homosexuality, leaving lasting legal and social consequences. Legal victories, from the Stonewall Riots to modern court rulings, have driven progress in decriminalization, marriage equality, and gender identity recognition. However, resistance persists due to religious beliefs, political ideologies, and concerns over societal stability. The role of tech companies in promoting LGBTQ+ narratives is significant, as they provide safe spaces, amplify voices, and challenge stereotypes. Yet issues such as content moderation, algorithmic bias, and concerns about free speech exist. As norms evolve, balancing inclusivity with cultural traditions remains a challenge. By fostering open dialogue and transparent policies, societies and digital platforms can work towards true equality.
