By Siddharth Baskar, Assistant Professor of Law at IILM University, Gurugram.

Abstract

The article explores the dynamic realm of employment law, focusing specifically on the intricate relationship between social security benefits and workers' rights. The established legal frameworks for safeguarding workers' well-being are encountering challenges because of the transformation of labour markets caused by globalisation and technological advancements. The paper examines the crucial legal principles governing employment rights, with a particular emphasis on the role of social security benefits in ensuring workers' financial stability. This paper highlights the necessity of a more adaptable legal framework by examining existing laws, global labour standards, and legal precedents to address contemporary issues such as the gig economy, informal employment, and the impact of technology on job security. The study proposes modifications to the legislation that would enhance the strength of labour rights and bolster social security provisions. This article aims to examine the challenges faced by Delhi residents employed in the informal sector across various industries regarding existing social security measures. Data was collected directly from the residents. The examination considers factors related to knowledge and working conditions, including familiarity with social security measures, daily working hours, weekly days off, presence of an internal complaints committee, availability of sanitary facilities at the workplace, awareness of maternity benefits, minimum wage, and equal pay for equal work.
