FREEDOM OF SPEECH -VS- HATE SPEECH LAWS: A COMPARATIVE ANALYSIS OF DIFFERENT LEGAL SYSTEMS WITH INTERDISCIPLINARY APPROACH

Abstract

 

Freedom of speech is a fundamental right enshrined in various international human rights instruments and national constitutions. However, its limits are tested when it comes to hate speech laws, which seek to curtail speech that incites violence, discrimination, or hatred. This paper provides a comparative analysis of different legal systems, including the United States, European Union, India, and other jurisdictions, to evaluate the balance between free expression and the regulation of hate speech. The interdisciplinary approach considers legal, philosophical, and sociological perspectives. The study explores key legislations, landmark judgments, and the evolving role of digital platforms in moderating speech. The paper also provides policy recommendations to achieve a balance between safeguarding free expression and preventing harm.
