The Maiden Pharma Cough Medicine Deaths: A Case Study On The Gambian Cough Medicine Deaths

Abstract
It may seem odd that something as routine as a cough syrup, which, in many nations can be made available even as over the counter medication, could be fatal. Yet in 2022, a shockwave hit Gambia and India when Indian origin Maiden Pharma’s cough syrups and cold syrups were allegedly proven to be responsible for the deaths of over 60 children which burst open the crack in the dam that is the legal provisions in place, both domestic and international, governing international pharmaceutical exports and the standards set in place to prevent sale of contaminated medication. This case study attempts to explain the facts of this case, discuss the current stalemate status the investigations seem to have reached, identify the legal provisions (or, where applicable, the lack thereof) that aided, if not enabled, these circumstances and its aftermath (including the alleged lack of culpability of maiden pharma) and also attempts to recommend solutions to some, if not all, of the issues.
