The Role of International Humanitarian Law in Protecting Children in Armed Conflict

Abstract


International Humanitarian Law is very important for legal protection of children in armed conflict it is provide rule and regulation that focus is to provide safety to children from the result of war that the children not harm and not face any violence because they need special safety during the war. Currently there are children all around the world whether it is Ethiopia to Afghanistan and Ukraine suffer without food, water, shelter and protection. In Ukraine there are minimum two children daily killed or harmed when the Russian invasion start from 2022.1 For preventing this situation there are many legal provision there in Geneva Convention and additional institution such as person particularly children who are not involved in conflict, shall in all situation of armed conflict be treated with care and empathy2 and also in the Additional Protocol I Geneva Convention states that the children should be treated with special respect and protected from any kind of inappropriate attack.3 In the Indian context, The Supreme Court of India through its analysis of Indian Constitution, specifically article that no person shall be deprived of his life and personal liberty4 play important role in protecting children in armed conflict. This research focus to explore effectiveness of these legal frameworks for development and it’s aimed at protecting children from the horrors of war. How effective is International Humanitarian Law in preventing the recruitment and use of children in hostilities? What are the challenges in the application of international humanitarian law when it to protecting children in conflict? This study contributes to the broader discourse on enhancing child protection in war zones.
