Uniform Civil Code: India Path To Equality

Abstract


India legal landscape is tapestry of huge and diverse castes, religions, and communities that speak different languages and followed different traditions and customs as per their personal laws and concept of UCC has gained significant attention and debate since India got its independence.[1]  Uniform Civil Code- proposal to unify personal laws such as divorce, marriage, inheritance, etc stands as front head of progress.[2]UCC enshrined under Article 44 of the Indian Constitution as DPSP which reflects Indian aspiration towards path of unity and equality, yet its implementation was a contentious and debatable issue. UCC imposes a positive obligation on the state to implement Uniform Civil Code but it is not enforceable in a court of law. While the idea of a Uniform Civil Code holds significant promise in ensuring equality and justice, it also holds a significant political debate over its implementation. This essay will explore and analyze the evolution, its transformative potential if is it implemented and to ensure dedicate balance between uniformity and diversity.
